Jane Doe v. ABC Employer

 

Ms. Bogaards settled a wrongful termination suit brought by her client, an account executive for the C.E.O. of a start up Silicon Valley tech company, for a significant confidential settlement at a pre-litigation mediation.

 

Her client was the personal assistant for the C.E.O. and the scope of her employment evolved to include doing personal tasks for his spouse and child.  Some of these personal tasks seemingly crossed the line.  Ms. Bogaards' client felt harassed and abused by the spouse.  Her client was asked to transport medication, handle the spouse’s ministeries, and other inappropriate things. 

 

Judge Jacobs-May at J.A.M.S. did a fabulous job at a half day mediation.  The defense firm, Littler, was a formidable adversary.  To prepare for mediation, Ms. Bogaards and her client organized binders of emails, text messages and other documents. They met to prepare for mediation so that Ms. Bogaards' client could feel safe and protected as well as to present her story in a clear and compelling way at mediation.
